Communal Dispute: Traditional Ruler Says Controversial Land Belongs To Ukpo Community

The traditional ruler of Ukpo community in Dunukofia Local Government Area of Anambra State, Igwe Robert Eze, has stated that the disputed land between his community and Abagana belongs to Ukpo both legally and historically.
This is sequel to the mayhem allegedly unleashed by Abagana people on Ukpo community on August 19, where a security guard was shot dead and property belonging to the police was destroyed.
However, the traditional ruler of Abanaga, Igwe Patrick Mbamalu Okeke, while suing for peace expressed confidence that the Police and the Committee set up by the state government will get to the root of the matter.
The President General of the Community, retired Group Captain Benson Okoye, and the Legal Consultant of the Community, Mr. Martin Anah, during a press conference at the palace of the traditional ruler reiterated the legal and historical rights of Ukpo people over the disputed land.
Group Captain Okoye stated that the land dispute between the two neighbours was in the law court for over 21 years after which judgement was delivered on Novem­ber 16, 2011 at the High court in favour of Ukpo before the appeal court also decided the case also in Ukpo’s favour.
Okoye highlighted the judgement of the court saying, “That the plain­tiffs (Ukpo) are therefore entitled to that piece of parcel of land situated at the Ukpo town which is more particularly de-lineated in plan No. MU/D6/96.
“That perpetual injunc­tion is hereby granted re­straining the defendants (Abagana) by themselves, their servants, agents and privies from further acts of trespass on the land.
He also admitted that after the above judge­ment, Abagana appealed in the Federal Appeal Court at Enugu (Appeal No, CA/E/86/M/2012) and presided over by Hon, Justice AJ Abudukadir, pointing out that the ap­peal ended on the Feb­ruary 4, 2013 again in favour of Ukpo and since 2011 till date, the judge­ment in favour of Ukpo community is still sub­sisting and has not been upturned by any court.
The Anambra State government has set up an Administrative Panel of Enquiry to look into the matter and proffer remedial measures.
